District Court Judge Lew in an , decided yesterday to hear the appeal on the Partial Summary Judgment. This was a particularly damaging decision by Riblet and was done without allowing defendants discovery. It used an inadmissible plea "bargain" as the only evidence. Defendants are elated at this development and are considering stays on all further proceedings until it is decided.
